These General Terms and Conditions (T&Cs) apply to all contracts between Adslation (hereinafter the "Provider") and the customer (hereinafter the "User") regarding use of the AI-powered translation service for advertising materials at adslation.com.
The User’s deviating terms are not accepted unless the Provider expressly agrees to them in writing.
The Provider makes a web-based Software-as-a-Service (SaaS) platform available to the User that uses artificial intelligence to recognize text in advertising images and translate it into various languages.
The scope of services includes:
The contract is concluded when the User registers on the platform and confirms their email address. By registering, the User accepts these T&Cs.
The User confirms that they are of legal age and have legal capacity, or that they are acting on behalf of a company and are authorized to represent it.
As a consumer, you have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us by means of a clear statement (e.g., by email to [email protected]) of your decision to withdraw from this contract.
Note: The right of withdrawal lapses for digital content if you have expressly consented to us beginning performance before the end of the withdrawal period and have acknowledged that, by giving your consent, you lose your right of withdrawal.
The User receives a non-exclusive, non-transferable right to use the platform for the duration of the contractual relationship. The User may freely use the generated translations for their advertising purposes.
The User undertakes to:
The Provider strives for high platform availability. However, uninterrupted availability cannot be guaranteed. Maintenance work will be announced where possible.
The quality of AI-generated translations may vary. The User is responsible for reviewing the results before use.
The Provider is liable without limitation for damages arising from injury to life, body, or health, as well as for damages caused intentionally or by gross negligence.
For damages caused by slight negligence, the Provider is only liable in the event of a breach of essential contractual obligations. In such cases, liability is limited to the foreseeable damage typical for the contract.
The Provider is not liable for the factual accuracy of AI-generated translations or their suitability for the purpose intended by the User.
The collection and processing of personal data takes place in accordance with our privacy policy, which is available on the platform and forms part of these T&Cs.
For subscriptions with a fixed term, the contract can be terminated with one month’s notice to the end of the respective term. If no termination is given, the subscription automatically renews for the same term.
The right to extraordinary termination for good cause remains unaffected.
The Provider reserves the right to amend these T&Cs with effect for the future. Changes will be communicated to the User by email at least 30 days before they take effect.
If the User does not object within 30 days of receiving the notice, the amended T&Cs are deemed accepted. The User will be informed of this consequence in the change notice.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from the contractual relationship is, where legally permissible, the registered office of the Provider.
Should individual provisions of these T&Cs be or become invalid, the validity of the remaining provisions remains unaffected.
